Public Consultation - Green Paper from the European Commission on policy options for progress towards a European Contract Law for consumers and businesses
The Consumer Ombudsman has submitted comments on the Green Paper on policy options for progress towards a European Contract Law for consumers and businesses to the European Commission.
The Consumer Ombudsman is unconvinced of the underlying assumption within the Green Paper, that differences in the member states’ contract laws are one of the key reasons why the internal market potential is not being fully achieved.
Before considering measures at Community level, the Consumer Ombudsman is of the opinion that the European Commission should carefully assess the potential advantages and disadvantages in relation to the different policy options from a consumer perspective. Several of the proposed options seem to raise fundamental questions concerning subsidiarity and proportionality.
